Terms of service

A short, plain-language summary of how Pact and its customers agree to use the platform — the counsel-reviewed canonical text follows on this URL.

This page is the plain-language summary of how Pact and its customers use the platform. The full counsel-reviewed Terms of Service are being finalised and will land on this URL without changing the principles below. The operative agreement between Pact and existing customers continues to be the signed master services agreement (MSA) between the two parties; nothing on this page modifies that contract. [counsel to review]

For self-serve and trial customers, the working principles are:

  • Account ownership. Whoever creates the workspace owns it. Workspace owners can promote additional admins; only owners can transfer ownership or delete the workspace.
  • Acceptable use. No spam, no scraping of personal data outside the controller-processor chain, no abusing the enrichment APIs to compile profiles outside a lawful basis. Pact suspends accounts that breach the consent model. High pay-as-you-go usage caused by abuse may be invoiced at standard PAYG rates plus an investigation fee; legitimate usage is never penalized retroactively. [counsel to review the abuse-vs-legitimate-usage line]
  • Data ownership — on every plan, including after downgrade. Your data stays yours. Read access to every record you have ever created is preserved on every plan, including the Free plan, including during the 30-day grace window after cancellation, and including after a paid subscription lapses for non-payment. One-click full export to CSV + JSON Lines is available from the account settings page on every plan. Pact does not gate read access to a tenant's own historical records based on plan tier. We do not train shared models on tenant data.
  • Plan changes — Free plan caps. Pact may change the Free plan cap structure, but binds itself to 60 days' advance notice before any reduction takes effect. Notice is posted on /changelog and emailed to every active Free plan user. [counsel to confirm jurisdiction-by-jurisdiction sufficiency]
  • Plan changes — paid plan list price. Paid plan list prices may change at renewal, with 30 days' advance notice before the renewal date. Mid-term list-price changes do not apply to existing subscriptions. Promotional pricing must disclose the renewal rate at the time of purchase. [counsel to review against EU consumer-protection durability rules]
  • Cap enforcement — soft cap, hard cap, no silent auto-upgrade. At 80% of a metered cap, Pact sends an in-app banner plus an email and offers a choice: buy a one-time pay-as-you-go bolt-on pack for the dimension, upgrade to the next plan, or reduce volume. At 100% of the cap, the writes that would exceed the cap stop until you make a choice. Reads, exports, and history continue uninterrupted. Pact does not silently move a tenant up a plan tier, and does not auto-bill a higher tier without the user's explicit consent through the account UI.
  • Pay-as-you-go charges. PAYG bolt-on charges are opt-in per metered dimension. Soft cap fires an email at 80% of forecast spend; hard cap blocks the action until the user explicitly accepts the next pack or upgrades. PAYG bolt-on pack rates are published on /pricing and any change to the pack rates gets 30 days' advance notice. Pact does not operate a multi-axis "credit conversion ratio" that is mutable at our sole discretion. We do not charge for failed lookups. [counsel to confirm 80% / hard-cap design clears US state UDAP statutes]
  • Cancellation — one click. Cancel takes effect immediately for monthly plans and at the end of the term for annual plans (no early termination fee). The cancel button lives on the account settings page, at minimum equally prominent to the upgrade UI. After cancellation, your data remains read + export available for 30 days, then is hard-deleted on a published schedule (sooner on request). [counsel to confirm the FTC Click-to-Cancel rule's specific requirements]
  • Refund policy. Monthly billing is non-refundable for the in-progress month; cancel takes effect at the end of the cycle. Annual prepaid is prorated-refundable within 14 days of cancellation; after 14 days the remaining months continue at the agreed rate without auto-renewal. PAYG bolt-on packs are non-refundable. [counsel to confirm states with stricter prorated-refund mandates (CA, NY) and to confirm Stripe Customer Portal defaults align]
  • Trial. Signup opens with a 14-day Pro trial — full features, no credit card required. If you do not upgrade by day 14, the account drops automatically into the Free plan; no data is re-migrated and nothing is deleted. Active sequences that exceed the Free plan's 1 active sequence cap are paused, not deleted. There is no auto-charge on day 15.
  • Service availability. Free plan is best-effort with no SLA. Pro targets 99.5%. Team includes a 99.9% uptime SLA. The MSA SLA attached to your order form takes precedence over this summary.
  • Termination by you. You can close your workspace at any time from Settings → Workspace → Close workspace; we hard-delete tenant data within 30 days of closure (sooner on request).
